This policy covers two different relationships, and it’s important to understand the difference:
Dealership customers (our direct clients): If your dealership uses Pagoda DMS, we act as a data processor on your behalf for the information you input into the system, such as your customer records, sales data, and inventory. Your organization remains the data controller for that information, meaning you’re responsible for how it’s collected and used, and we handle it according to your instructions and this policy.
Website visitors and prospective customers: If you visit our website, request a demo, or contact us for information, we act as the data controller for the information you provide directly to us.
Information dealerships provide to us: Business and account details, including company name, contact information, and billing details. Data entered into the Service by your team, including vehicle inventory records, customer contact information, sales and service history, invoicing data, and staff user accounts.
Information collected automatically: Usage data, such as login activity, feature usage, and system performance metrics, used to maintain and improve the Service. Device and browser information, including IP address, browser type, and operating system, collected when you access our website or the Service. Cookies and similar tracking technologies used on our website for functionality and analytics purposes.
Information collected through our website: Contact form submissions, including name, email address, phone number, and any message details you provide when requesting a demo or consultation.

We retain information for as long as necessary to provide the Service to your dealership and to meet legal, accounting, or reporting obligations. If your dealership ends its relationship with Pagoda Labs, we will retain or delete your data in accordance with the terms of your service agreement, unless a longer retention period is required by law.
Depending on applicable laws, you may have rights regarding your personal information, including the right to request access, request correction of inaccurate information, request deletion, or object to certain types of processing.
